O jornalista e o sigilo das fontes

Um artigo excelente de Anthony Lewis no International Herald Tribune a propósito do julgamento de Lewis Libby Jr, o chefe de gabinete do vice-presidente americano e a questão da violação da confidencialidade das fontes, um dos problemas quentes do sistema judicial e constitucional americano.

The remedy in such a civil case [journalists having an absolute privilige to testify] is not to put reporters in jail in order to force them to testify. It is, rather, to make the press pay for the injury it caused. That is what actually happened in the Wen Ho Lee cae. Five news organizations, includint The New York Times, agreed to pay Wen Ho Lee $750,000 - which they said was not to compensate for his injury but to protect their journalists and ten right to confidental sources.
